$15 Million Settlement – Breach of Contract

Attorneys: Brian J. Madden and Marc K. Erickson

Brian Madden and Marc Erickson represented Citadel Plaza LLC (Citadel), which settled a commercial case against the City of Kansas City, Missouri for $15 million on the Friday before trial was to begin. The case involved a failed Tax Increment Financing (TIF) Plan called “The Citadel” near 63rd and Prospect streets in Kansas City.

In the 2003 NPM Adjustment Proceedings Before an Arbitration Panel Pursuant to Section XI(c) of the Master Settlement Agreement:

Attorneys: Eric D. Barton and Tyler W. Hudson

After the major tobacco companies initiated arbitration against 46 states seeking contract adjustments of more than a billion dollars for the year 2003 under the 1998 Master Settlement Agreement (“MSA”), Wagstaff & Cartmell was selected to act as counsel for Kansas in the arbitration matter. For 2003, Kansas alone had more than $50 million at risk. Eric Barton and Ty Hudson shared co-lead counsel responsibilities.
