Attorney Brian Madden and others at Wagstaff & Cartmell settled a personal injury case for a confidential amount in which it was alleged that a driver lost control of his vehicle while accepting a cell phone call. The driver left the roadway and struck three pedestrians, injuring one and killing two.
The negligent driver was allegedly not working at the time of the accident. However, Wagstaff & Cartmell alleged that the driver’s employer shared responsibility for the accident because the driver was using a work-issued cell phone. Additionally, the driver had inadequate training with regard to use of the cell phone while in transit.
