The Washington Post recently published an article stating that there have been over 18 deaths connected with a strange vaping illness and over 1,000 vaping-related injury cases, so the age of ‘vaping hysteria’ is very much alive and real. Vaping has quickly become a significant issue surrounding American school districts everywhere, primarily because of its popularity. As vaping continues to exponentially grow as a massive health issue, school districts are being forced to divert their public funding and other resources away from education.
One of the main culprits and subsequent defendants of this hysteria is JUUL, a popular vaping company that has dominated the e-cigarette market in recent years due to their device’s size, flavor assortments, and nicotine potency. JUUL and other vaping companies have worked tirelessly to achieve their goal of hooking an entire generation of young people onto nicotine while simultaneously coming off as a healthier alternative to cigarettes, but the recent crises in rising vape-related death/injury tolls and school district funding allocation around the country has everyone taking a very close look at JUUL.
Vaping lawsuits have to lead to injury plaintiffs all over the country seeking physical, emotional and financial damages, and our team of experienced personal injury law experts is here to support victims of these harmful nicotine devices. Wagstaff & Cartmell is also very proud to be a part of a co-counsel that is currently representing three school districts against JUUL Labs as they pursue financial compensation for the vaping manufacturer’s accountability towards the diversion of resources, including time and public funding.
We are concerned about the threats to public health and safety that major vaping manufacturers like JUUL have created throughout school districts nationwide, and we’re confident that we’ll be continuing to crack down on JUUL and other vaping corporations for instilling a public nuisance within our nation’s youth and publicly-funded school districts.
We are also honed in on how vaping plays a role within personal injury lawsuits on an individual basis, so if you or a family member has suffered any kind of injury as a result of using an e-cigarette device, you should contact us for a free consultation so we can go over the intricate details of your situation and begin the initial steps towards a successful legal strategy.
Wagstaff & Cartmell is Currently Assisting Three School Districts Across the Country in Lawsuits Against JUUL Labs
The Wagstaff & Cartmell team is currently a part of a co-counsel that has filed lawsuits on behalf of three different school districts in Missouri, Kansas and New York against JUUL Labs. These are monumental lawsuits that are building momentum across the country as our three school district clients seek to protect their student bodies and hold JUUL accountable for diverting public funding and other resources away from the districts’ education.
These three lawsuits claim that JUUL utilized deceptive marketing in order to specifically target a young demographic, while at the same time knowing perfectly well how the product designs and flavorings catalyze addiction risks. Each of the three school districts has publicly stated that JUUL’s actions as a vaping manufacturer giant have created a public nuisance and a significant threat to public safety and health.
School districts across the country already have very limited funding, and having to reignite a battle against nicotine addiction is costing valuable resources that should be going towards the education of the country’s youth. JUUL is not the only vaping magnate responsible for this epidemic, and these lawsuits are now ensuring that vaping manufacturers everywhere are put on notice so they fully understand that their contribution to the degradation of public health and safety will not go with impunity.
The three plaintiff school districts include the following:
- Olathe Public Schools USD 233 is the second-largest school district in Kansas and currently serves over 30,000 students.
- Francis Howell School District is one of the largest Missouri school districts and serves about 18,000 students.
- Three Village Central School District is a New York school district that serves over 6,000 students.
School districts have undoubtedly been disproportionately and uniquely impacted by JUUL and other vaping manufacturer’s conduct, and the amount of spending school districts have had to expend is only continuing to rise. School districts everywhere are now installing vape-specific sensors in bathrooms, have banned USB flash drives, and have even removed bathroom doors, among many other taken steps to combat the current nicotine addiction epidemic.
JUUL isn’t alone in creating this epidemic across America’s school districts, but JUUL does hold around 75% of the vaping market. They have intentionally lead an “arms race” oriented around nicotine by providing fruit-flavored pods that would obviously appeal to younger users and increasing their nicotine levels and delivery systems have made it easier than ever to become quickly hooked to their products.
These types of stealthy marketing techniques created an industry-standard that other vaping conglomerates had to follow in order to remain competitive, and the results have been disastrous for the health and financial resources of the county’s school districts and beyond.
How Does an Individual Qualify for a Vaping Personal Injury Lawsuit?
Wagstaff & Cartmell has become renowned throughout the country through our success within personal injury lawsuits, and there are two different categories of vaping personal injury lawsuits you should know about: (1) wrongful addiction and (2) vaping injury.
- Wrongful Addiction Cases: In these vaping lawsuits the plaintiffs are essentially alleging that vaping companies and manufacturers utilized misleading claims or improper marketing in terms of product safety to subsequently lead them into trying the vaping product, which resulted in their physical addiction to the nicotine products. The plaintiffs will be citing their addiction as their injury, and subsequently seeking the associated damages for their addiction.
- Vaping Injury Cases: These vaping lawsuits involve an individual suffering a physical injury or death as a result of vaping products. There have been thousands of reported cases involving serious respiratory injuries and even 18 deaths related to vaping thus far. So these injury claims will be filed as traditional product liability lawsuits against a vaping company.
