Marc Erickson joined Wagstaff + Cartmell in 1999. He has over 20 years of experience in civil trial practice, with an emphasis in medical malpractice, personal injury, natural gas and propane explosions, electrocutions and other claims against utilities, products liability, business litigation and municipal zoning law.

Marc has successfully tried numerous cases to verdict in Missouri and Kansas, in both state and federal courts. His defense verdicts in Mitchell v. Evans, Beaty v. Saint Luke’s, and Connors v. Goeking were recognized as some of the top defense verdicts in 2006 and 2007 by Missouri Lawyer’s Weekly. As a former certified fire and explosion investigator through the National Association of Fire Investigators, Marc has handled claims investigations and litigation in fire and explosion cases throughout the country.

Notable Litigation

  • Defense Verdict – Hip Replacement Medical Malpractice

    Vanessa H. Gross and her partner successfully defended a local orthopedic surgeon in a jury trial in which the plaintiff alleged that negligent placement of a component during a total hip replacement surgery caused subsequent dislocations and revision surgeries. After a four-day trial, a Johnson County, Kansas jury returned a verdict in favor of the client.

  • Defense Verdict – Perforation to Esophagus during Esophageal Procedure

    Wagstaff & Cartmell successfully defended a gastroenterologist in a jury trial in Jackson County, Missouri, in which the plaintiff claimed past and future damages and injuries due to an esophageal perforation sustained during an esophageal procedure.

  • Defense Verdict – Alleged Failure to Timely Diagnose Stroke

    Wagstaff & Cartmell attorney, Diane Watkins, successfully defended a physician and a nurse in a jury trial in which the plaintiff alleged that the clients failed to timely diagnose a stroke.

  • Citadel Plaza LLC v. City of Kansas City, Jackson County, Missouri – $15 million settlement

    Wagstaff & Cartmell represented Citadel Plaza LLC (Citadel) in a commercial real estate case against the City of Kansas City, Missouri. The City failed to provide partial funding per their contract for the project, after the client expended significant time and money redeveloping the site.
